Dated “New Orleans, November 25, 1862.” 21 pp., 5” x 8, string bound. Fine condition.
This order presents the findings of thirty court martial cases convened under the authority of Col. B.R. Merritt, 75th New York Vols.
Most cases involved relatively minor infractions, though not all. Two verdicts called for execution by firing Squad—the first culprit being Pvt. Charles Hall, Co. “D”, 12th Maine, convicted of murder for forcing Pvt. James Murray into the moving machinery of a steamboat. The second malefactor, Pvt. Christopher Low, Co. E, 4th Wisconsin Infy., was convicted of absenting himself [desertion in the face of the enemy] for a full day during the Battle of Baton Rouge.
One soldier—Private John Tracy, Co. K, 13th of Co. F, 12th Maine was convicted of conduct prejudicial to good order and discipline—insulting two sergeants and threatening to kill a private. Sentenced to be confined at hard labor for a year at Ft. Pickens wearing a ball weighing 24 pounds attached to his left leg for the same period. Another—Pvt. Michael Killohy, Co. “E”, 9th Connecticut Vols.--was convicted for violation of the 9th Article of War, for saying to a company officer—”By Jesus Christ I will drive my bayonet through you.” His sentence: To be confined at hard labor on the fortifications of the United States on the Island of Tortugas for a period of five years.”
